Possible Restrictions on Recovery Under State Law

State law does not grant injured parties unlimited time to file their lawsuit. Under 42 Pennsylvania Consolidated Statutes §5524, the deadline for most personal injury claims is two years from the date of the accident. However, there are some rare exceptions to this time limit.
Additionally, 42 Pa.C.S. §7102 states that injuries parties who are found more at fault for their damages than all defendants in their claim combined are ineligible to recover any compensation. Those who bear some degree of fault are subject to a reduction in payment based on their percentage of liability.
