Does The Other Side’s Insurance Pay My Medical Bills?


Hi, I’m John Ostroff. Thanks for visiting ostrofflaw.com. You clicked on the question as to whether the other side’s insurance, the party that caused you harm, their insurance pays your medical bills. Sometimes they do.

You have insurance under your own insurance policy that covers your medical bills, at least in part. If you click on the question that’s below, you’ll see that we address that directly. How and why your insurance will cover some of your medical bills. But let’s say that you only have the Pennsylvania state minimum of $5,000 in medical insurance. It’s also called PIP. Personal injury protection. I’m gonna call it PIP to keep things simple.

So let’s say your PIP is $5,000 and your medical bills are more than that. Let’s say they’re $20,000 more than that. Or let’s say you fall and you have, it’s not an auto case and you have no insurance to apply to that. Any medical bills that are due out of your settlement get added to what you’re owed by the other side as a result of the claim. So if you have a pain and suffering claim for your injuries, and let’s just say it’s worth $80,000. And let’s say you have $20,000 in medical bills. It can either be over what you have in car insurance or you have no health insurance and you fell. And you have no insurance to cover that. In either event, if your case is worth $80,000 for your injuries, add the $20,000 that you owe, in addition to your injuries. For your medical treatment. And now the full value of your case would be $100,000.

So you may have a source of payment for your medical bills, from within your household, your car insurance, maybe a health insurance policy, but if you don’t, then the other side that caused you the harm you suffered would be responsible for that. And that amount would be added to the value of your claim. I hope that answers your question, thanks.
